When using products and services (the “Services”) provided by iChess LLC, including its affiliates (“iChess”, “we”, “us” “our”), iChess will collect, use and process your personal data. iChess takes your data privacy seriously and processes your personal data in a secure and confidential way in line with GDPR requirements.

This privacy policy (“Privacy Policy”) explains what personal data we process, how we process it, for what purposes and on what legal grounds. The Privacy Policy also explains what rights you have and can enforce in relation to our processing of your personal data. 2. Processing of personal data in the Services

When you create an account on iChess for purchasing digital chess content, subscriptions, physical chess equipment, or any other items in our store, we will obtain personal data about you such as your name, address, phone number, and email address. We may monitor your use of iChess through the use of cookies and similar tracking devices. For example, we may monitor how many times you visit, which pages you go to, traffic data, and location data. This information helps us to build a profile of our users, which we use to help improve the way we deliver our Services to you. Some of this data will be aggregated or statistical, which means that we will not be able to identify you individually. e) Marketing and profiling

We want to help you get the most out of our Services. Therefore, we will send you, or otherwise notify you, of various offers and activities via email, e.g. in the form of newsletters, e-marketing letters, unique offers based on your preferences or information about other special offers. For this purpose, we will process your email address as well as previous preferences, purchases or participations in contests and special events.

We will also collect and use personal data to be able to provide you with relevant information and advertisements, hereunder through advertising and ad serving technology. In relation to this, iChess processes personal data such as demographic and geo-location information, information logged from your hardware or device (to ensure that relevant advertising is presented within the Service), IP address, e-mail address, device ID, MAC address, installed software, application usage data, hardware type, operating system information, browser information, unique identifiers in browser cookies, Flash cookies, and HTML5 local storage as well as internet and on-line usage information. iChess uses third party service providers in order to operate the ad serving technology, cf. section 5 “Use of Cookies”.

Further, we may use profiling techniques to propose to you certain content types or titles. We do this on the basis of your usage patterns of iChess, including previous purchases.

The legal basis for processing data as described in this section is your consent and our legitimate interests in earning revenue by ad serving through the Services. For more information, please see sections 2. g. “Improving and developing the Services” and 5 “Use of cookies”.

f) Prevent and uncover misuse of the Services

If we detect irregular activity in your account, we will take necessary action. This may include processing of personal data.

g) Improving and developing the Services

When you use our Services, we collect and use personal data related to user activity, for the purpose of analyzing how our Services work and improving them correspondingly. For example, we will retain and evaluate information on your recent visits to and use of our Services, as well as how you move around different sections of our Services. Such analysis helps us to understand how visitors and customers use and navigate our website, so that we can make our Services better and more user friendly. Even though some of the data collected for these purposes contain your personal data, most data collected from analysis will generally not contain any personal data.

3. Access to personal data

iChess may use third parties, including its affiliates, to collect and process personal data on behalf of iChess, in order to provide you with the Services as well as improve and develop the iChess website, applications and related equipment. Such subcontractors of IT-services includes Chase Paymentech, Authorize.net, and/or PayPal. These subcontractors may have access to personal data if the personal data is stored with the subcontractor or in other ways are available to the subcontractor in accordance with their contract with us. If applicable, iChess has entered into data processing agreements with these subcontractors, which act in accordance with the terms of the data processing agreement and under our instruction. The subcontractor can only use the personal data for the purposes decided by iChess and as described in this privacy policy.

Further, iChess may share personal data with its affiliates for the purpose of carrying out joint activities throughout the group, such as marketing activities.

Information about you in relation to your use of the Services will be processed in a secure and confidential manner, and will only be accessed by personnel or third parties if it is necessary in order to provide the Services to you. iChess does not disclose personal data in other circumstances or ways than what has been described in this Privacy Policy, unless you explicitly request or consent to such disclosure.

• Ensure nobody else will use iChess while you are logged into your account (we advise our users to take extra care when using public computers/devices and to NOT leave themselves logged in; it is your responsibility to ensure this does not happen);
• Log out and exit your account on iChess when you are not using it, on any private and/or public computer or device; and
• Keep your password and any account details or access details secret and to yourself.

5. Use of cookies

Our Services uses cookies and similar technologies, such as web beacons or pixel tags. A cookie is a small text file which is placed onto your computer (or other electronic device) when you access our website. We use cookies on iChess to:

• recognize you whenever you visit iChess (this speeds up your access to the website as you do not have to log on each time);
• obtain information about your preferences;
• carry out research and statistical analysis to help improve our content and Services and to help us better understand our visitor requirements and interests;
• make our shopping basket and checkout work;

If you give us information on behalf of someone else, you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:

8. Do not use iChess for private and sensitive data

iChess is a resource to help you improve your chess learning. We do not wish for iChess to be used for the processing of any sensitive data. Do not use iChess in any way to share with any user any personal contact information like your phone number or street address. Do not use iChess to send or store any item revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

iChess does and may contain links to other websites. This Policy applies only to our website, www.ichess.net, so when you visit other websites please read their privacy policies, as we cannot accept any responsibility for breaches or issues you may have in relation to privacy once you leave our website. While we do our best to curate links, we can’t be responsible for them.

10. Where we store your data

The personal data we collect is stored on the servers of our service providers who help power iChess.

Some or all of your data may be stored or transferred outside of the European Economic Area (“the EEA”). We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the EEA and under the GDPR.

11. Your rights

You may choose not to provide us with personal data and you may turn off cookies in your browser by changing its settings. If you make these decisions, you may continue to browse the pages of iChess.net. However, the site may not function as intended and we will not be able to provide you with our listed products and subscriptions.

You have the right to ask us not to process your personal data for marketing purposes.
